Glamour Photography Model Release Form?
I will be starting to do Glamour, Boudoir, and Nude Photography which puts me in an interesting spot because some of my clients will only want me to place certain photos on my site with their written consent. Granted, I do not mind at all about this since I will not be selling the prints and only use them for advertising but most of the model releases I have state clearly that they give up all rights and I can basically can do whatever I want with the photos. Is there a release form that anyone may know I can use which may apply more for this type of photography? If there isn’t, how should I tackle these types of obstacles where a model would only allow me to use certain photographs? Logically I will need to have them sign a realease but how can I go about it? Let me know please.
If this is customers coming to and paying you for personal shots then it falls under section 85 of the UK copyright act and I believe that the US copyright act has a similar provision.
This states
A person who for private and domestic purposes commissions the taking of a photograph or the making of a film has, where copyright subsists in the resulting work, the right not to have-
(a) copies of the work issued to the public,
(b) the work exhibited or shown in public, or
(c) the work broadcast or included in a cable programme service;
Which means that you as the photographer have to get the customers permission before publishing or displaying those photos.
You must have your own terms and conditions for your business (you to have t&c’s for the customer to sign don’t you?) so just add a clause in there which gives you permission to use the pictures for display purposes etc.
This is what any decent portrait and wedding photographer will do and this is no different for glamour, boudoir and nude in these circumstances.
